2. 目的: 对方责任的情况下, 如果只赔车损加 medical bill,
绝对是不公平的, 因为车是修不到原来的 value 的,
加上突然事故造成的各种不方便, 对方绝对应该赔付
额外的损失.
另外, 因为是小事故, 所以不推荐请律师, 一是请
律师不一定容易, 二是考虑律师也要分钱(小事故能
打下来的钱本来就不多).
3. 说明: 提供一个方案而已, 如果自己觉得请律师更好,或者
干脆认为自己太面,不愿意找麻烦,不在乎那几千块钱
赔偿,看到这里就可以了.

然持有原数量的股票。我file了equity claim，claim的金额是最初购买股票时投入的
金额。破产公司回应说因为我是“common stock holder”，因此没有资格file equity
claim，它要向破产法庭file omnibus objection to claims，目的是expunge我的
equity claim并将我的equity claim reclassified to equity interest。我现在还有
机会向破产法庭递交一个response，说明为什么我认为我应该可以file equity claim。
请教版上大神，有没有懂这个的？我该如何回应，写这个response？难道真的像破产公
司说的，因为我是“common stock holder”，因此没有资格file equity claim？有没

我还发现我和我lg去年用学校的glacier系统报州税，结果那个系统默认我们身份为
single而不是married seperately，并且因为我们都是single,所以系统让我们俩分别
都claim了我们的儿子为dependent？（不过我claim dependent没什么实质性效果，因
为我去年才拿了900多刀。）但是，系统这样报税是不是其实是不对的？
我今年拿的钱比较多，所以claim不claim dependent就会对税有所影响了。谁能指导我
一下，看我们能不能claim dependent?

份就可以claim吧？ 有的地方写的只能claim一次，请问这个说法是不是准确（没找到
出处， 8863 form上part III line 23写的“Has the Hope Scholarship Credit or
American opportunity credit been claimed for this student for any 4 tax
years before 2014?”， 但没提这个Lifetime Learning Credit）。 我的情况是，去
年自己交了一千多的学费，可以拿回200多刀，但今年快毕业了有可能出去做intern然
后自己交好几千甚至上万的学费，所以如果只能claim一次，明年再claim就比较划算。
问题： Lifetime Learning Credit 是不是只能claim一次？如果是，是不是必须成为R
的第一年claim，还是可以在符合条件的任何时候都可以claim？

Points在机场的Alamo定了的四天车，拿到一辆2016年的Hyundai Accent。本人自己无
车无车保，因为Chase信用卡也自带Collision Damage Waiver，所以拿车时也都
decline了Alamo的其他offer。
一路相安无事，结果回到机场还车的时候，检察员发现车右后轮上侧车体被刮蹭并有十
厘米左右的穿空，我懵了一下因为之前完全不知情，明显是在某个parking点被人撞挂
的。倒霉归倒霉，于是作了个Express Incident Report，签了字我们就飞回纽约了，
检察员说他们的Fleet Manager会进行确认后跟我联系修车理赔事宜。
两天后收到Alamo邮件，说车确实是在我租的期间被撞坏的，已被送去修理，让我交$

third party在用我们的account寄东西。我们这个是我们自己的公司(dealalive LLC)
账号。公司，公司员工，员工的亲朋好友以及我们授权的都可以使用这个账号。
shipper (default), buyer (or recipient), third party 都可以file fedex
claim.不过buyer or third party file claim得时候，需要shipper 通知fedex
shipper waive the right for the same claim 因为一个label只能有一个claim.
buyer or third party file online claim要通过他们自己的fedex.com
account来进行。如果没有fedex account, 可以自己注册一个(免费)。file
claim在fedex.com/us下面的"manage"->"submit claims".

要不然为什么不只claim两条，比如authorship, contribution， 把review放在

先说下自己的情况：cs的，两篇journal,11篇会议，2个book chapter，2个patent，
120多点的citation,26个review，2个会议的PC
首先问问该claim什么，1b只要claim两个，我是不是只claim authorship和
contribution就好了，review那个就放contribution里？因为感觉自己review很弱，又
容易被RFE.不是很明白的是看版上大家1b也一般claim三个，有什么原因吗？
主要想问问推荐信，这个最无头绪，不太明白各个方面的推荐信应该如何support.
1. 如果claim review，推荐信就是来自editor，说明reviwer是如何如何牛？
2. 如果claim contribution，推荐信主要来自citation的作者，说明自己的
publication如何影响了他们？
3. 如果claim authorship,推荐信主要来自大牛们，说明会议或杂志是如何的top?
请前辈们指点，万分感谢！ |

发帖数: 379 | 30 因为EB1B只需要claim两项，本人的citation 过低，所以在想能否只claim
contribution 和review而放弃authorship。contribution有媒体报道，推荐人的证明
，也可以把文章放到contribution里进行强调。Review的数量和分布国家也还可以，一
共三十出头，十七个国家的文章。这两项都有硬性证据证明，唯独authorship 缺少
citation的佐证。
不想单独claim authorship 主要就是因为引用低，怕站不住脚，如果上面两项claim够
的话，就打算放弃claim authorship，以免画蛇添足。但是又考虑到不claim
authorship的case是不是不多？IO会不会因为不claim authorship而觉得case 很弱？
请大家给点意见，非常感谢！ |

发帖数: 23 | 31 公司律师，F家。我们打算claim authorship和contribution。这俩条我们觉得背景还
行，应该够了。但是律师非要claim 4条。
仅靠一篇非一作的review paper，律师要claim participation as a judge。我们没有
提供任何审稿的材料，自己也只有3篇审稿。
仅靠别人的review article cite了我们的文章，律师就要claim published materials
written by others about alien's work。
我们提出了异议，指出1）就写过一篇review，反而显得judgement work不frequent,
especially compared to peers. 2）别人的review article 只是cite我们的文章，没
有重点讨论，不符合这条criteria。我们建议这两个claim都拿掉避免被uscis
challenge.
但是律师非常自信的说根据他们的经验，这两个claim没有问题，会让整个case更加

发帖数: 4283 | 32 房屋保险实际是就是保灾难性的事故的，当然小到你洗脸盆水漫出来把洗澡间淹了你也
可以claim, 保险公司是会理赔的。但是他们是肯定会秋后算账的，你如果一直claim,
保险公司最终是会拒绝你投保的。然后你claim的记录是业界联网的，也就是说你被一
家据了以后，也很难被其他保险公司接受的。
一般的ice dam都是小事故，墙壁进些水在冬天没啥关系的，其实就是刷个墙，4，5千
的理赔，还要扣掉deductible+折旧，不值得惹一身骚。
举个例子，你今年claim了ice dam（小事故），明年claim个水管爆裂（中等事故），
后年不小心厨房起火了（大事故），你claim还是不claim? 所以说要把life line留给
灾难性的事故，保险公司一次两次还是会容忍的就是涨点保费，3次以上，你就out了，
一旦out以后，你就out了。
然后你反过来想想，这么多老美，钱太多了？力气没地方用了？除什么雪？除什么ice
dam? 房顶塌了,不是正好用保险给换个新房顶？ice dam不正好把房间重新刷一刷？ |

亚麻的AZ claim 刚刚修改了规则，以前是开了case，不管你赢还是输，都计算在你的
seller metrics里头。但是现在你要是赢了case, 就不再计算到你的seller metrics里
头。所以如何去赢一个case会比以前更重要。
首先说按照现在的规则，有一些claim是几乎必输的，比如buyer说东西没收到，
tracking显示delivered, 但是你没有购买signature confirmation.以前75刀以下亚麻
还给cover，现在这种一般是判你输，你还要退钱，最最好的结果是亚麻自己替你赔钱
（几率很小了），但是case还是你输了

怪事来了，我的保险公司不是Allstate，然后也没有file claim，也没有accident 打
电话给Allstate提供这个claim number，居然找到了信息，还说就是今天提交的，我的

是信息混淆了，是不是他们的数据库出问题了？match信息到我这了？我之前只是填过
quote保险的信息，所以他们有我的地址，电话，生日也不奇怪，问题是这个claim怎么
出来的呢？肯定有人提交了啊
难道是万圣节的恶作剧？哈哈 这要是真有个人提交了claim信息，收不到电话和邮件
得多着急啊！Allstate真是个奇葩的公司，这都可以搞错！
请问大家，如果我不联系他们也没关系吧，我估计adjuster会联系我，客服就说告诉
adjuster这个是wrong information就行了，然后没有accident |

我有很多receipts，但离职后事情比较多，一直没顾上这件事。直到几个月后，联系公
司怎么claim，对方说，超过90天了，没法claim了。
他们给我发了一个文件， HealthSmart Flexible Benefit Plan。文件里有， “You
will have 90 days following your termination date to remit claims incurred
through your coverage termination date.” 我感觉没希望claim回来了。就放弃了。
最近在报税了，好心痛这笔钱啊。请问有什么办法要回来这笔钱吗？
另外就是提醒版上的xdjm，最好离职前把钱claim了。如果没有，离职后尽快claim。 |

还是要跟版上大家请教下，最近正在跟律师搞petition letter, 关于claim,我有一个
疑惑，就是下面这条：

这个就是大家通常所说的media report了把，我并没有media report，可是律师说：“
is not limited to media reports. For scientific fields, a significant number
of citations can serve as evidence to meet this statutory requirement.”。
。可是问题是我总共也就100多点儿的引用，于是就跟律师说能不能去掉这个claim，因
为并不是claim越多越好，只要老三样搞好就行了，可是律师又回复：

claim media report，这样共claim 3项 contribution+media report+authorship, 我
一篇paper大概有30+media report（包括一些知名媒体），但是只有两个提到了我的名
字，剩下的都是提到我的study，不知道这样单独claim会不会引起不必要的麻烦。大侠
们怎么看？
还有律师写的petition level里面claim的名字也没有走寻常路，看了内容才知道他

上周四我和lg商量着要先找Eric negotiate 一下在我们file court compliant之前。
我们发给他一封邮件，问他接不接受500块（其实根本不值得这个数），周六之前不回
，表示不接受，我们就file compliant。结果他没回，今天收到他的邮件说他已经告我
们到small claim court。真是超级无赖，满口似有非有的谎话，居然先告状。这个
small claim court也很奇怪，好像只能file claim用来要钱的，我们这样被 put
unfair mechanic lien 不能用。我们只有有冤无处申呀。气人！这个恶人先告状了，
是不是对我们不利？

我觉得取决于claim起来有多容易，主要是最恨扯皮，打个比方说：
老人甩了一交骨折了，按我们的理解觉得这种旅游保险应该是保的吧，但是如果你
claim后，人家说虽然你是跌了一跤骨折了，但是这个跟很多pre-existing的因素有关
，比方说糖尿病，骨质疏松等等，你必须提供你的医疗记录说明你不存在这些问题，
blah,blah，当你好不容易搞来了这些证明，然后如果保险公司说，这些证据还不足以
说明问题，我们需要这里的医生的second opinion, 你那些中国的证明不管用，你是花

本来initial claim一直在下降，可是这两周却开始上扬。我认为这是market开始悲观
的一个重要支
持。moving average 比每周的数值得看。不过如果下周或下下周数据又降下去了，市
场可能有回
