royalty income的sharing plan，是学校专利办公室的一个职员起草的，应该是依照学
校惯例。这里面申请人总共分了1/3的net royalty income，几个人平分。我想这里面
有两个学生，两个老板，其中我老板lead这个工作，可是他分的和我们一样多，是不是
不合适？？
这种情况，如果是您，会提出把自己的income捐给老板么？或者捐大部分，留1%？关键
是还有另一个学生，而且另一个参与的是我副老板，只和我有关系，我如果自己公开这

SB. If you understand anything about rule of law, you would know "现代法律
观念" doesn't mean applicable laws, certainly doesn't mean applicable laws
when Mao was alive and receiving the royalties.
If Chinese laws at the time did not say any writings of Mao during his time
as public officials belong in public domain and doesn't qualify for royalty

以前在美国大学工作时申请了一些专利，所以现在会有一些专利收入。
最近才发现2012学校寄来的1042-S表格，原来学校withhold的30%的收入。
2012我没有file美国税表，因为除了这些少量专利费，我没有其他美国收入。
想请教一下。
1. 现在如何claim退税
2. 我在美国的专利收入按照什么比率缴税。
按照中美tax treaty, article 11, 如果按照第一段，那么我可以不交美国政府任何税
，如果按照第二段，我应该交10%税。

吗？
而且你是把专利转让，不是licensing，licensing才收Royalty
公司申请专利这件事本身也不是直接获利的，要enforce patent right，licensing的
时候才来谈拿钱拿royalty的事情。这里的误区是专利本身可以换钱。
综上所述，即使你的工作合同里没有写，你这个assignment和royalty也没有关系。
所以比较大的可能是你能拿到的就是有些公司用来激励员工申专利的奖励费和专利批准
之后的名誉认可（专利上你是inventor，类似于发表论文）

我的看法基本上可以概括如下:
1) 由于partnership已经搞定, 短期内没有噱头了.
2) Biotech最近总体走的不好.
3) VNDA今后的看点在于销售量, 可能要一年, 至少两,三个季度才能看出点端倪, 由于
Novartis自己也有药在市场上, 它对于Fanapt的销售倒底会持什么样的态度, 我猜不出
来. 有兴趣的同志自己可以去查一下Novartis的药的专利到期时间 (2016年).

说事没必要。 Apple至少与20多家公司打过官司；原告和被告都有的。 我最大的
Concern 是Apple以其巨大的财力，通过官司手段，在手机领域里消灭竞争和垄断市场
。通过封闭系统，在市场上绑架用户，不断地高利润的炸干用户的钱包。 HTC 官司后
几乎再也没有能力和APPLE 竞争。Nokia和Rimm 几乎已经垮台。唯有开源的 Android
阵营。 开源与封闭的斗争在我看来如同公益与自私，正义与邪恶的斗争。开源则是鼓

们的app，网站就只能长得跟东施似地。网上有很多免费的设计资源可以利用。但用的
时候要看清licence，免得以后麻烦。我先抛个砖。
什么样的免费资源可以用：
下面几种license可以随便用：MIT, apache, BSD, BSD2, LGPL, GPL2. 注意有的
licence要求你的程序保留原来的版权声明，比如BSD2；有的你可以随便乱搞，比如MIT。

标 题: 如何利用网上的免费资源

大家都是穷程序员，写个app，做个网站什么的通常请不起专业的美工，但不意味着我
们的app，网站就只能长得跟东施似地。网上有很多免费的设计资源可以利用。但用的
时候要看清licence，免得以后麻烦。我先抛个砖。
什么样的免费资源可以用：
下面几种license可以随便用：MIT, apache, BSD, BSD2, LGPL, GPL2. 注意有的
licence要求你的程序保留原来的版权声明，比如BSD2；有的你可以随便乱搞，比如MIT。
注意：LGPL和GPL2比较tricky，见PNSH的回帖。
有限的使用：CreativeCommons
大多数图片和艺术类的资源都是这种license。CC稍微有的tricky，用的时候要看清楚

State Department spends $70,000 on Obama's books
The State Department bought more than $70,000 worth of President Barack
Obama’s books, The Washington Times reported Tuesday. The books, mostly
Obama’s 1995 bestseller, “Dreams From My Father,” will be used as
Christmas gratuities for embassy staff and to stock “key libraries” around
