1) I-140 已经获批；
2) I-485 提交了 180 天未决；
3) 新职位和 I-140 上的职位是相同或相似。

移民领域也不除外。
在移民法律业务内做的最大的移民律师事务所是Fragomen，第二是Foster Quan，第三
大的是Berry, Appleman。美国大的多业务律师事务所也很多有移民的业务，譬如
Seyfarth Shaw LLP，Morgan Lewis，Paul Hasting等等。做的好的个人律师也很多，
譬如Ira Kurzban, Carl Shusterman等等。至于说移民不需要做诉讼更是错误的概念。

是一个省略倒装句式的虚拟条件从句（表示与过去事实相反虚拟条件句的句式），其标
准句式相当于：

memo讨论的情景是alien实际上用了AP出入境, 所以使用了虚拟条件从句。
整句话中文意思：
如果外国人的H1/L1没有过期，假定外国人没有（注意是没有）使用AP出入境，那么INS
就不会认为申请人使用H1/L1工作（而不是设法使用其他工作许可）是非法的。

说实话，06年上半年EB2排期的运气算不错了。申请绿卡一年就拿EAD/AP，很多人等了

有些人已经转了EB1拿了绿卡（我认识的人里就有好几家这么做了），还有人被lay off
（这个不知道有没有影响），还有人需要提交新的体检和指纹（这个很恶，但要求如此
）。总之，可能有很多case即使是valid，也不是ready to be approved。如果最后一
个月剩余很多，大跃进然后再后退在所难免。 |

2007年1月1日，然后10月VB再退回2006年3月1日，都是很正常的。估计现在有些case并
不具备在1-2个月内被批准的条件，为了不浪费名额，向前推进个大半年是make sense
的。 |
