我看法院网站说如果 trial by mail 输了要求上court，法庭会重新考虑，但是
sentence 还不局限于原先 trial by mail 的sentence. 所以觉得要是trial by mail
输了，就不想费劲再上庭了。

标 题: 求助超速之后pre-trial和上庭的问题（NY）

5月份的时候在高速上，下大雨，结果没看到后面的警车，（据警察叔叔说）跟了三四
个mile之后亮灯pull over，给了罚单，写的限速65开80。
寄回罚单，plea not guilty，拖了好久之后收到了回复，说9月30号pre-trial。小弟
第一次吃罚单，有这么几个问题整不明白：
1、pre-trial和上庭是啥关系？是说pre-trial谈不拢再开庭吗？
2、听说pre-trial会给几个选项，什么上驾校不扣分，什么blablabla的，请问通常都
有哪些选项呢？
3、所谓的上驾校不扣分具体是怎么回事，求达人解释一下。
4、也是听说 警察不来的话案件就直接dismiss掉。这个警察来不来是指pre-trial的时
候还是开庭的时候呢？

是同步的。
走的是state highway, 4５mph 的限速，我的车速大概在４０－４５之间（大多数人开
５０），开到一路口时绿灯变黄，就减速准备停下来，快到停车线的时候发现路边计时
器上还有３秒，就松了车闸接着走了，没想到在过线的那一瞬间，黄灯变成了红灯（计
时器上还有２秒），那时我的车速比较慢，可能在２０－３０之间，然后也没太加速就
顺其自然过路口，用了大概2-３秒的时间（路口有１００ft）。有个警车当时停在路口
前面约１０－２０米的路边，立刻闪灯，我告诉他过线的时候是黄灯，他说“i make
my decision based on my judgement.” 并给了RAN RED LIGHT 的罚单。还说我开车
慢，it is a good thing.
后来按照罚单上的地址去了justice of the peace court,想plea not guilty，拿回来
一张notice of trial setting.今天才发现上面有两个选项:

果Trial by Written Declaration输了还可以重新上庭，跟一开始没有区别。
你选什么样的trial跟你怎么方式plead是两码事。无论你做Trial by Written
Declaration或直接上庭，你都可以亲自去法庭plead not guilty，或通过邮件plead
not guilty。
如果通过邮件plead not guilty，要提前起码5天寄出。 |

感觉国内的CRO,包括WXpharmtech, Shang Pharma做的都是pre-clinical的. 但国内现
在clinical trial的平台也越来越多, 那么这些TRIAL主要是为国外已经批准的药品进
国内市场服务的,还是为international multi-center trial服务的?
另外,各大药厂在蒲东好象都有clinical development部门, 这些人在上海主要是干什
么? 是自己去做trial, 还是起衔接他们公司和CRO的作用?

但现在job interview必须要准备一点Clinical trial的东西。不然，什么job都找不到。
先来说说我的印象，希望帮我纠正。我印象中clinical trial不就是一个randomized
experimental study吗? 被试随机分配到E和C组，然后比较一下effect of treatment.
一个简单的ANOVA不就能够对付了吗？不知还有什么别的花样。至于power analysis和
sample size在这种design下，用G*Power或nquery自动就给你算出来。有什么麻烦的呢
？
最近我们所做了一个phase 4的longitudinal clinical trial study. E和C组分别是
两种治疗方法，然后治疗开始后的1，3，6，12个月测量outcome variables. 治疗本身

full payment. place an 'x' in one of the boxes only if you are paying for
that option. 这两句话矛盾的啊，还是这个full payment有其它意思？
2）两个option，一个是court trail，另一个是trial by declaration，这个是不是就
是Trial by Written Declaration？我想走这个的话是不是就check这个，然后再支票
上写not guilty就行？
3）这个大概要多久会有回信？怕来不及due date了，过了due date好像可以申请
extension，对Trial by Written Declaration也有效么？ |

选项包括：
Proof of Correction; Amount Due with Proof of Correct N/A.所以这项我不能选

前的帖子, 有人说trial by declaration失败了以后还可以上庭一次, 但是今天去了法
院交罚单的时候, clerk说, court trial和written declaration只能选一个, 如果
declaration失败之后没有再上一次法庭的机会...请问这是一般情况吗? 还是我之前的

,给你寄过来form,然后你写写，寄回去，附上支票，最好注明如果输了,你还要上
