比如pfizer的抗癌药A过期了， 某小药厂作A的肥胖症治疗通过FDA批准了，
则授予该小药厂专利，
在此专利期内， 医生要治肥胖症开A药必须使用该小药厂的产品， 否则算侵权
这样做有什么漏洞嘛？

发帖数: 1290 | 5 好像是这样的。美国这边处方药控制得很紧，没有医生的处方，药房不卖药给你。而医
生明知 A 公司的药和 B 公司的一样，如果A有用于新适应症的独占权，他也只能开 A
公司的药了。
谁知道新适应症的独占权怎么获得，保护多久？

发帖数: 251 | 7 这个确实是一个问题，现在很多off-lable的应用，我个人认为，谁发现谁就应该享
有新的专利权，只是是和原药厂分享，这个很重要，如果没有相关政策的话，很多价廉
物美的药物都不能正式进入临床，并在在使用过程中对于医生也存在风险。 |
