d***e 发帖数: 104 | 1 The State Department recently announced that EB-2 priority date cut-offs for
India and China will retrogress to August 15, 2007 as of the May 2012 visa
bulletin. USCIS has advised that, after the retrogression, they will
continue to “preadjudicate” adjustment applications received through April
2012. The “preadjudicated” cases will be held by the State Department in
the “pending” demand file. That way, the cases will be ready in October,
or earlier, if the current number use pattern changes, and they are needed
at the end of this fiscal year to assure utilization of the full employment-
based permanent resident visa allocation.
Your adjustment of status application is currently pending, and based on
current processing times it is unlikely to be approved prior to the
retrogression. Once the priority dates retrogress, USCIS will not be able
to approve your application until your priority date again becomes current (
we are unable to predict how long that may take). In the interim, we will
work with you and your employer to extend your work authorization and travel
permission as needed.
