help.
My wife's 6 years H1b has already used up. She changed to another job using
AC21 with another 3 years H1B extension because she has a green card
application pending – her previous company filed a PERM and a I-140 for her
but her priority date was not current so she didn’t file I-485.
Her current company's paralegal said they would need to start the green card
process very soon for her before her priority date becomes current. Her
priority date was Jan 2008. The green card visa is currently unavailable and
no date was posted on visa bulletin in recent months. But the latest
priority date that was available was 8/12/2007 (according to May 2012’s
visa bulletin). We don’t know if the priority date would advance further
when this fiscal year’s visa becomes available in October. Her paralegal
had suggested that they should start the process before her priority date
from previous green card application becomes current.
But her HR dept mentioned the general policy is to initiate the PERM after 1
year of employment. Could you please give us advices on how to maintain my
wife's legal status and initiate PERM? Thanks! |
