收到律师的回复，吓了一跳，难道新的EB3 140还有可能会影响到之前EB2的140么？
“- Theoretically, a petition that qualifies for EB2 also qualifies for EB3.
However, refiling the I-140 petition will require USCIS to review the
merits your case once more, which increases the overall chance of a
government challenge. This fact has proven problematic in past cases where
the government approved the initial EB2 petition but then challenged the EB3
refile due to circumstances the government did not notice in the initial
filing.”
另外，我中间换过部门，但job similarity is more that 50%, 如果考虑降级，以前
的PERM还会有效么？
我就是想分析一下利弊的因素，再决定是否降级

发帖数: 278 | 3 我也面临类似的问题。我们律师很谨慎，因为之前公司重组，我的EB2 file的时候做过
Succeed-in-interest。公司的破律师觉得会影响到老I140.
但是其他的考古都表明只要不revoke和撤销EB2 I-140, 就没有任何影响。
另外，我EB2的PERM里面写了最少Master +2-year,。律师说因为这个所以不能EB23同时
申请。但是我的理解是降级不受影响，对不对？
有大Niu看一下吗？
