Basic background, I submitted my RFE without adding my case number (My
mistake. I originally planned to photocopy the RFE letter since both SRC and
A numbers are on the first page, but right before submitting the RFE, it
was found that only the yellow page was required. I did not notice that
there was no SRC or A# on that page, stupid!!)
After less than one week, I received the message that my case was denied.
After several days, a denial letter was received along with RFE package. On
the top of RFE, a page was attached to request A# or SRC#
Since they did not receive the A# or SRC# within 87 days, so they denied my
case treating as abandoned because of failure of to submit evidence or
respond to a request for evidence.
In the denial letter, it is saying there is o appeal to the decision.
However, I can file a motion to reopen or reconsider under 8. C. F. R. 103.5
within 30 days.
What I can do and you kind suggestions are greatly appreciated. | T*******y
发帖数: 6523 | 2 Motion to re-open seems like a reasonable choice. Now that you have all the
documents ready, just send them in ASAP with a cover sheet to explain this
missing SRC mistake. It does not hurt to do so.

They can just call me or email me to request the SRC number after receiving
the package. It is really ridicoulous!

Don't appeal, because you will lose. You sent material without case number,
and expect USCIS smart enough or even bother to find your info for you. | r*******y
发帖数: 136 | 11 I totally agree that it is my fault for missing SRC#. However, it is their
fault to send me the request BEFORE denial letter instead AFTER denial
letter. There is at least one week period between the request and the denial
letter.
