In disclosure the seller did not disclose there was a treated 6 feet linear
crack in the finished basement 8 years ago. So after inspection, we made a
deal to close on July 31. Now no more contigent. Yesterday I found it out
and seller told me it is precautious fix before finishing the basement, but
I still think they should disclose it. It affect my confident in the house
and owner.
How should I do? I already passed the inspection period and I put in $4000
earnest money. There is no financial contingent. Should I let it go or
Should I ask for price reduce? It is $400K house and the seller do not worry
selling the house if I am out of contract, and do not return our earnest
money.
Thanks for your idea and opinion.

honestly I don't think it's a big deal if it's a vertical crack - leaving
it as is when exposed or waterproofing it before covering with sheetrock
is the standard way to do. I don't the seller is obliged to disclose this
- otherwise there would be a very loooong list to disclose about a house.
If it's a 6-foot horizontal crack, that's a bit disconcerting...

这个basement是finish的吧。。。更好奇楼主是怎么发现的?我这边的house一旦
basement finish好了,什么都看不出来了。。。

my agent told me so also. He said it is not a big deal and it is normal for
cement basement.

There are 4 hairline cracks in the unfinished area, I asked the history of
the cracks as far as owner knows. They did not answer at the first time.
After a few day in my second attempt,
they surprised me by replying " are you referring to the professionally
treated crack...".
I immediately followed with request of
warranty copy, repair paperwork and answers of which wall and if it is
vertical/diagonal/horizontal. It's been 4 days, I sent them 3 emails with
the same request, each time they just reply one thing, first warranty copy,
then unreadable
paperwork.(each time takes them more than one day) I am waiting for their
3rd reply as to if it is diagonal(BTW, from
warranty, it is not horizontal).
I do not understand why they are reluctant to answer all my questions to
ease buyer's worry if there is nothing serious. They said it never leaked
and only as precautions
before finishing the basement which happened 4 years later after repair. But
I think they
should disclose the repair from the beginning so that when we did inspection
,
we would know where the repair is and pay more attention. Secondly they
should actively provide all the information to ease buyer's worry.
Should I trust them? I am already under contract without any contingency
anymore and with $4000 earnest money. What do you think/do under this
situation? Any comments and replies are highly appreciated.

为什么8年前的CRACK不用DISCLOSE了? There is one part in disclosure for seller
to disclose any repair in the basement.
