1. Start with IRS form W4 and the Labor Department's form I-9. Form I-9
requires that you take a look at official documents to insure that the
employee is allowed to work in the US. Passports, drivers licenses, birth
certificates, and social security cards are the types of documents you must
review. I like to exercise extreme caution and keep a photocopy of these
important records in my payroll files.
2. Request an employer identification number from IRS by filing form SS-4.
3. Check your state tax filing requirements. This presents yet another
complication. We may already be confused by the 2 different filing
requirements at IRS, or $1,100 per year for the purpose of Social Security
and Medicare taxes, but $1,000 per quarter for federal unemployment taxes.
In addition, you may face different filing limits for state income taxes,
state unemployment taxes, and required state disability and workers
compensation insurance policies. Thankfully, NY State has recently
consolidated unemployment and income tax reporting. However, one of my best
clients recently forwarded me a notice from the "Workers Compensation Board"
stating there were different requirements depending upon the number of
hours worked by his domestic employee.
4. After checking your state requirements the next step is to arrange for
the appropriate insurance. In most cases, NY State requires both disability
and Workers Compensation policies.
5. Withhold the proper amount of Social Security and Medicare taxes. The
combined rate is 15.3%. You can split this with your employee or you can pay
it all. You are not required to withhold federal or NY State income tax,
but you can if you and your employee want to.
6. Adjust your estimated taxes or withholding tax to reflect the additional
payroll taxes you now will owe to Uncle Sam. Unless you are self-employed
and have other employees, the social security and Medicare taxes will become
part of your income tax liability for this year. You can be penalized if
you don't pay enough estimated tax before each quarterly due date.
7. File the appropriate returns with your state or local tax departments. NY
State requires quarterly reports.
8. File form W-2 to report the employees’ wages for the year. The employee
copies are due by January 31 and the government copies are due by the end of
February.
9. File Schedule H with your income tax return. Unless you are self-employed
, you must report household employment taxes with your 1040.

The above is the standard procedure for hiring a household member. When you
pay your parents to take care of your child, you and your parents are
employers and employees, which is why you'll need to take care of everything.
When you hire an external babysitter, she/he is self-employed, so you don't
have to worry about social security, etc. But you will need to notify IRS
the SSN of your babysitter, so that IRS can ensure that your babysitter pays
her own dues.

This definitely helps. Thank you very much.
Though I still don't see the technical difference between hiring your own
family and hiring outside helpers. In my opinion the relationship is always
employer-employee in both cases. Why is it that when it's from outside, the
helper is deemed as "self-employed"?

The difference is, when you hire someone from outside, this person is
usually a licensed daycare provider and has her own business. She is
providing you a paid service and it's not an employment relationship (just
like when you call in a licensed plumber to fix your sink, you're not his
employer). Since you're not your babysitter's employer, you're not required
to withhold those taxes. Of course, if this outside babysitter doesn't have
a business, then it will be in the same situation as your parents.
The bottom line is, when you go on the record by paying a person out of your
FSA money, SOMEONE--either you, or your parents, or your babysitter--will
have to pay those taxes. IRS doesn't really care who picks up the tag, as
long as they get the money. So, if you use your parents, they'll have to pay
income as well as those other taxes, which will make it meaningless to have
the FSA in the first place. Better keep quiet.

Ha! That's a good point. Why didn't I notice that? Since LZ's parents only
have ITIN's, not SSN's, the chances are they don't have green cards yet.

关于请自己的家人做depedent caregiver.pub503第7页里有这么一段:
Payments to Relatives or Dependents
You can count work-related payments you make to relatives
who are not your dependents, even if they live in your
home. However, do not count any amounts you pay to:
1. A dependent for whom you (or your spouse if filing
jointly) can claim an exemption,
我觉得如果这个亲戚不是你的dependent(这个要看1040表instruction的第16页的定义)
就可以替你看孩子拿钱.
楼主的父母如果有工作许可,而且不能做为你的dependent应该是可以拿钱的.

如果他父母能合法工作,那当然可以拿钱看孩子。但现在不是能不能的问题,而是值不
值的问题。存FSA无非就是想省钱,难不成左手接过IRS的钱,右手再替他父母给IRS还
回去?除非他和父母之间是完全的financial独立,不在乎父母到底交多少税。这个在
中国人里很少见。
