仔细看了Net Investment Income Tax的Form 8960, Line 4a 是从1040 Line 17来的。
而1040 Line 17是从Schedule E来的。Line 22 (6) allowed income or loss this
year is 0.

investment income by definition is passive
the link is just an example. The principle here is passive loss offsetting
passive income regardless it's current year or carry over.
capital gain doesn't have to be from selling real estate. stocks work too.

In general, net investment income for purpose of this tax, includes, but isn
't limited to:
interest, dividends, certain annuities, royalties, and rents (unless derived
in a trade or business in which the NIIT doesn't apply),
income derived in a trade or business which is a passive activity or trading
in financial instruments or commodities, and
net gains from the disposition of property (to the extent taken into account
in computing taxable income), other than property held in a trade or
business to which NIIT doesn't apply.

The definition of net investment income has nothing to with whether your
income can be offset by rental loss.

It seemed that the passive rental loss can not be used to offset the net
investment income, similar to the rule that it can not be used to offset
ordinary income. It can only be carried over to offset future property sale
capital gain or future passive rental income.
