An attorney representing Donald Trump’s campaign has warned the Nevada
Republican Party to be wary of "voter intimidation tactics" from Ted Cruz’s
campaign ahead of the state’s caucuses on Tuesday.
In a letter to state Republican Party Chairman Michael McDonald, Trump
counsel Donald McGahn cites a series of allegations of underhanded tactics
from the Cruz campaign, such as a Wall Street Journal report that suggests
Cruz’s campaign has told its supporters to use their cellphones to record
video of anything that looks suspicious as they enter caucus sites.
“We find this information especially troubling given Senator Cruz and his
campaign’s track record of election shenanigans,” McGahn writes, noting a
2012 guidance from the Justice Department that said photographing and
recording voters could violate federal law, as well as additional state law.
“The recording of citizens engaged in voting is especially concerning
because of its potential intimidating effects on voters,” McGahn continues.
“The Cruz campaign’s public statements putting voters on notice that Cruz
supporters will be videotaping may have such an effect on those who wish to
exercise their right to caucus. Such activities could violate state law and
the Voting Rights Act.”
McGahn has asked the state party to discern whether such recording is lawful
and called for the state party to maintain citizens’ right to vote. “We
further urge the Nevada Republican Party to ensure the rights of all
registered Republicans who seek to exercise their right to cast a vote in
the upcoming Caucus are maintained—including those of first-time Caucus-
goers and those who may be unfamiliar with the process—and make clear that
voter intimidation tactics will not be tolerated,” McGahn writes.
As noted in the document, Cruz’s campaign and surrogates encouraged Ben
Carson’s supporters to caucus for Cruz in Iowa after telling voters the
retired neurosurgeon was dropping out, and Cruz’s campaign has also faced
scrutiny for posting a Photoshopped image of Marco Rubio shaking hands with
President Barack Obama on its website.
Most recently, Cruz fired top communications aide Rick Tyler after he shared
a story that misstated Rubio’s remarks about the Bible. “I have made
clear in this campaign that we will conduct this campaign with the very
highest standards of integrity,” Cruz told reporters Monday.
