一种办法是出境，但我没有valid visa stamp，那么去加拿大是不是还要先美国大使馆
签证，有了visa再入境才能得到新I-94？或者file I-129，申请费是多少呢？320刀？
用visa auto revalidation rule,可以不用申请签证，但似乎也不能拿到新I-94了？

expired, you have valid H-1B status in the US.

immigration officer in the airport when I entered US) will govern...not the
I-94 on my I-797A. |

迢来是想要EXTEND你的I-94而已，因为：你现在有了新护照了。一般来说，CBP会理解
的，会给你的；当然，这个也要靠运气。不管运气是否好，你最多只是浪费了钱和时间
而已，是一定可以回美的。
如上的是最方便的做法了。
当然，你也可以去加拿大墨西哥，然后在加拿大的美国使馆去签美国签证，再入境美国
。这就是另一个故事了，有它自己的变数了。更加麻烦，也不一定就会成功，等等。 |

valid I-94, you're fine.
If you really need to be assured, bring the new passport, I-94 and I-797A to
the nearest CBP office (usually located in airport) and ask them to update
the I-94.

unless there was an error in issuing the original I94.

can enter canada.
2) if you go to canada and apply for USA visa, and do not get USA visa
unfortunately, then strictly speaking, visa auto validation rule wont apply
anymore, and CBP can deny you entry to USA...

and don't give any detail until you get into their office, usually they won'
t push you out of the door and will just correct the I-94.

发帖数: 15689 | 20 I doubt USCIS will accept such application, since the H-1B petition is
already approved. There are similar cases before and USCIS usually just
mailed the application back and said such request is not within their
authority.
