f****n 发帖数: 63 | 1 I plan to visit Canada for several days. I have some questions about when I
re-enter US. My US visa already expired (but I have my valid I-94), and I
changed my visa status from F-1 to H1B in the US not from my home country.
Is there any problem you can think of that I may have when I re-enter US? I
was told as long as I-485 not submitted, there will be no problem to re-
enter the US from Canada and it won't affect my green-card process, am I
right?
Sorry I cannot type Chinese here.
Thanks | t********o 发帖数: 25 | 2 You will take risk. I had an experience in 2006. I felt desperate at that
time even though they allowed me re-entry. At that time, I held H1-B and a
letter from school international office to indicate by law, I do not need
visa after short stay in Canada. However, the Custom Officer did not think
so. They emphasized to me that you need a visa to come back USA. For
whatever reason, they granted me re-entry, but I missed my flight. I did not
give the I-94 when I left USA. I did not affect your greencard application
at all since I am an example. Hope helpful!
