Re: Epson – Tortious Interference with Contract
To Whom It May Concern:
We have been retained by Epson America, Inc. ("Epson"), in regard to issues
related to your improper and tortious sale and commercial distribution of
Epson products. As you are aware, Epson develops, manufactures, and sells
products throughout the world, including the United States. Epson sells
products directly to customers through its network of Authorized Epson
Dealers. Epson has and continues to designate significant resources to
develop and maintain its products’ national and international image.
Through this market of Epson Dealers, Epson has fostered a recognized image
of quality and customer support
All Authorized Epson Dealers are required to execute a Dealer Agreement
whereby they agree to the manner in which they must promote and sell Epson
products in order to maintain and foster Epson brand equity. The Dealer
Agreements limit Authorized Epson Dealers to selling Epson products to the
end-users. Unauthorized Resellers who induce Authorized Epson Dealers to
sell Epson products to them tortiously interfere with the Dealer Agreement.
As Epson has no record that it has authorized your business to resell its
products, Epson demands that you discontinue your tortious conduct and
notify the undersigned of your compliance by November 26, 2015. Nothing
herein is intended by us, nor should it be construed by you as a waiver or
relinquishment of any rights or remedies which our client may have in this
matter, and all such rights and remedies are hereby specifically reserved,
including, but not limited to, contacting your internet servicer provider to
take further action and an accounting of damages in the event that
litigation becomes necessary. Should you wish to discuss this matter,

Re: Epson – Must We Sue Letter
Dear Sir or Madam:
Must we sue to get a response to our letter dated 11/19/2015? (Copy enclosed
.)
In order to avoid actions in furtherance of our client's demands, please
contact the undersigned via e-mail or fax within five (5) days with either a
notification of your full compliance or a reasonable explanation as to why
you believe your actions are justified.
This letter is sent without prejudice as to the other rights and remedies
available to our client, including without limitation, contacting your
internet service provider to take further action and/or an accounting of
damages and profits, in the event that litigation is necessary.
