发帖数: 3862 | 9 说 IO都有PHD,也太没根据了，他们的专业著作RFE letter，只是一个通用模板，适用
于所有情况,IO也就根据具体案例，在适用的条目下加点批注而已， 不用大惊小怪。
但是说他们是没见过世面的高中生，也是不负责任的说话。他们也许不懂专业术语，也
不可能懂得eb1申请中各种不同的专业，但他们肯定都是受过USCIS培训的，熟知USCIS
和法律的条款的，对于各种申请的要求到了抠字眼的程度。不管你自己认为你的水平如
何，你提供的材料一定要足以让他们信服你已经达到USCIS要求的水平。
而且USCIS要求burden of proof取证的责任在申请人，而不在IO, 而且要求的只是可以
相信的证据，而不需要像刑事案件里那样严格的证据，所以提供有足够可信度的证据和
逻辑清楚没有漏洞紧扣要求的petition letter,非常重要。而且我认为其实证据相对
petition letter更加重要，因为对于IO来说，他的任务是对你提供的证据作出他的判
断，所以证据的组织和呈现相当重要，在这个意义上，petition letter起到一个帮助
呈现的作用。 |

, It should be vary from case to case. I don't think a person who don't
know you at all, will be willing to write the letter for you. I tried many
times, even those who knew my boss but don't know me won't write the letter
for me. A BT person never write the letter even my boss recommended and he

confirmation letters. But that's not the purpose for me to get this letter.
I think the letter might not only state how many manuscripts I have reviewed
for the journal but also state that they have a high standard for the
selection of reviewers and how good are my review works. Is this too much?
but I saw a lot of other people here who shared their experience after their
cases were improved all mentioned like this.

officer去judge.
我只所以这么想，是有正反的例子。
我有一个朋友在我看来case不是很强，他找的律师就是一锅煮的petition letter,信中
从来没有说符合哪几项几项，只是笼统地说符合140 EB1B的条件。在他的信中，如果分
开来看，他的律师写了很多点，包括发表文章，获奖，judge,以及媒体报道。他的各项
都不强，比如Judge就是一个conference session chair; 媒体报道也就是其中的一个
报道中引用了他的一个观点提到了他的名字,文章真正的peer-view journal article
也不多，把他在学校图书馆网站上发表的文章算过去了，citation在petition letter
里根本就没有提，一句话都没有（估计他的citation也没有多少所以就干脆不提）。他
的case最后没有RFE就直接过了。我想如果他的petition letter一项一项分开写的话，
可能大部分都要RFE.

Q1, RFE Letter 里在要求补材料之前有这么一段话，

今天收到email说approve了。
公司办了EB1B，但是一直久拖不决，最近拿到了另外一个公司的offer，所以下定决心
申请EB1A，熬了两个星期的夜，DIY petition letter。材料装订完全按照USCIS的要求
，打两孔，用ACCO fastner，加tab。
顺便问一下班上的xdjm，我现在递交485的话，应该让哪个公司开employment letter？

信心，一个是review另外一个是一个专利。review我没找来editor letter；专利批准
了但是没有被应用啊；
我问律师，律师的逻辑是，我们写了4项，只要他们承认2项就行；如果现在把那些放在
contribution里面，万一RFE，我们就没有backup；有些理解，但是还是很担心，和版
上其他人的不一样；
2）搞不明白，律师写了一个公司letter，只有4页，看起来也不是offer letter，里面
主要是说公司的情况和我的情况，和我满足的条件，以及可以为公司将来带来利益等等
。我问这个是不是PL，秘书说是；但是律师又说会补充一个cover letter，会联系推荐
信和我的资料，强调我的符合资格。感觉怪怪的，不过律师说开业15年只有一个failed
，所以还是觉得相信他一把，但是心里不踏实啊！
3）我公司总部在West Virginia，我自己在加州工作，两个地方分属不同center。我倒
底是会被分到哪儿审批啊？

letter呢，而且上面写了一堆的东西没有一样可以看出来是“research”。
但是我又在班上看到很多人拿到offer letter的RFE，不知道到底要不要交，公司的律
师就说一般是在university的人申请EB1B的时候，一定要offer letter，在外面公司的
就不需要了。
请有经验的指教，这个offer letter的目的到底是什么。到底要不要交呢 |

For the petition letter, they normally call it "140 case letter". The
international staff(or whoever handling your case will draft it). You have
to
speak with them using their language, not the language on this board. They
have different names for different documents and their own way to handle it. |

CV，说可以提供模板。然后都是他们refer给相关人给我写信，一般都是publisher，那
些人说不能用我的模板（这个我可以理解），但是写来的信怎么都这么差呢？感觉只是
证明了我帮他们审了稿而已，可这个我不需要他们证明，我已经有证据了。

刚刚收到律师的petition letter draft，30多页，claim了老三样，基本上就是把
reference letter照抄了一遍，letter里citation数目和内容基本没提，替代的是行业
内一个paper数据库的download stats(2000+ downloads)。而且律师把11封推荐信都用
上了（没留着准备RFE的，汗）。
大家看看这样的letter能行吗？EB1B要求两条就够，是不是把review放到contribution
里面会更好一些？可不可以直接pp？ |
